摘要:

在农村生活中多见且犯罪率极高的犯罪中，让人容易想到的就是盗窃罪和诈骗罪。在一般 情况下，这两种犯罪易被区分，但随着农村社会发展，被告人取得财产的手段多样且日趋复杂；当今理 论界对这两种犯罪行为的区分观点也不相同；刑法又不能包括所有犯罪行为；这使两罪间界限模糊。 因此，本文通过对盗窃罪与诈骗罪的界限评析，列举国内外专家、学者在理论、司法层面遇到的两罪间 的问题，通过分析比较，结合司法实践中的案例、判例，总结出解决两罪间界限问题的方法，希望在今 后实践中有帮助。

Abstract:

Theft and fraud are very common in village life and have high rate of crime. In general, these two kinds of crime are easy to distinguish, but with the development of the village society, the defendant means of acquiring property variety and increasingly complex, today's theoretical ideas about the distinguish of the two kinds of crime are different, and the laws can’t include all of the criminal law crime, these make the boundar? ies between theft and fraud phenomenon. Therefore, this article through to theft and fraud, the boundaries be? tween listed domestic and foreign experts and scholars in the theoretical and judicial level between the two crimes problems, through the analysis and comparison, based on cases in the judicial practice, summarizes the methods to solve the problem of boundary between two crimes, in order to provide help in the future prac? tice.
